Pilot Scheme on Private Adjudication of Financial Disputes in Matrimonial and Family Proceeding
Practice Direction on the Pilot Scheme on the Private Adjudication of Financial Disputes in Matrimonial and Family Proceedings – SL9 issued by the courts came into effect on 19th January 2015 and the scheme will run for an initial period of 3 years. All relevant parties first have to agree to submit their financial disputes in matrimonial and family proceedings to adjudication, and shall be bound by the decision of the adjudicator, in terms of the procedure of adjudication. The adjudication process is quicker and more flexible than litigation. The decision made by an adjudicator is final, but is subject to the overriding discretion of the court.
